Terms of Service

These Terms of Service ("Terms") govern your use of ILX Calcs (web), the online structural calculation service at this website (the "Service"), provided by ILX Studio, LLC ("ILX Studio", "we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service for a firm, you confirm that you may accept these Terms on its behalf.

1. The Service

ILX Calcs is a design aid for structural engineers. It performs structural calculations and code checks of members, foundations, walls and loads based on AISC 360-22, ACI 318-19, NDS 2024, SDPWS 2021, TMS 402-22, AISI S100-16, AISI S400-20, ASCE 7-22 and related references, and produces calculation reports and drawings. It is the online edition of ILX Calcs; a desktop application is planned.

2. Professional responsibility

The Service does not replace professional engineering judgment. You, or the engineer of record you work for, are solely responsible for the input, for checking the results, and for every design, drawing and report you issue. Read the Disclaimer, which is part of these Terms.

3. Accounts

  • You must give accurate account information and keep your password confidential.
  • You are responsible for activity under your account. Tell us promptly at services@ilxstudio.com if you suspect unauthorized use.
  • One account is for one person. Accounts may not be shared.

4. Free trial, subscriptions and payment

  • New accounts receive a free trial period of 30 days.
  • After the trial, continued use requires a paid subscription, monthly or yearly, per user (one seat per person), at the prices shown on the Pricing page when you subscribe, in US dollars, plus any applicable taxes.
  • Founder pricing. While the founder offer runs, the first 100 subscribers pay the discounted founder price shown on the Pricing page. A founder keeps that price for every renewal for as long as the subscription stays active without interruption. If the subscription is cancelled or lapses, the founder price ends, and a later subscription is at the price of the day.
  • Purchases are processed by Stripe, which sells the subscription to you as merchant of record and reseller (your receipt shows "Sold through Link"). Stripe handles checkout, sales tax or VAT, receipts and payment support. Your card details go to Stripe and never reach ILX Studio.
  • Subscriptions renew automatically until cancelled. You may cancel at any time; the subscription then ends at the close of the paid period.
  • We may change prices for future periods with at least 30 days' notice. Price changes do not apply to an active founder subscription.

5. Desktop application license

The ILX Calcs desktop application is in development and is not sold yet. Its price and license terms will be published on the Pricing page and in this section before it is offered for sale. Telling us you are interested in it does not create any purchase or obligation.

6. Your content

Your projects, inputs, drawings and reports ("Your Content") remain yours. You give us permission to store, process and back up Your Content only to provide the Service to you. We do not sell Your Content or use it to market to others.

7. Acceptable use

You agree not to: attempt to access other users' data; interfere with or overload the Service; reverse engineer the Service except where the law allows; resell or provide the Service to third parties; or use the Service for any unlawful purpose.

8. Availability and changes

We work to keep the Service available and accurate, but it is provided without a guarantee of uninterrupted operation. We may update, add or remove features. We will give reasonable notice of changes that materially reduce the Service.

9. Intellectual property

The Service, its software, design and documentation belong to ILX Studio, LLC and its licensors. The codes, standards and design examples the Service refers to (for example those of AISC, ACI, AWC, TMS, AISI and ASCE) are the property of their publishers. ILX Studio, LLC is not affiliated with or endorsed by any of them.

10. Warranty disclaimer

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the extent permitted by law, ILX Studio, LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or business, arising from the use of the Service. Our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim.

12. Termination

You may close your account at any time. We may suspend or close accounts that breach these Terms. On closing, you may request an export of Your Content within 30 days, after which it may be deleted.

13. Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules.
